(50), 650 [i.e. 648], (40) pp. First Dutch edition of one of the most popular law manuals of the 16th and the 17th century in the Southern Netherlands. Joost de Damhouder from Bruges (1507-1581), a celebrated jurist and high civil servant to the Kings of Spain in the Netherlands, had won great fame by his manual on criminal law, which he first published in Latin in 1554. The present manual on civil law was first published, also in Latin, in 1567. The author himself was preparing a Dutch translation, but he died before it was finished. The present translation was newly made after the Latin by an anonymous translator (attributed to Carel van Nispen by Van der Aa). De Damhouder's law manuals ware much in use, and were translated into French and German. Their popularity was based on the fact that here Roman Law was adapted to local practice and to customs and traditions of Northern Europe. Later research somewhat diminished De Damhouder's fame, as his works proved to have been mainly based on Filips Wieland, a Flamish jurist of the first half of the 16th century, to whom really belongs the honour of first having written an original Dutch civil and criminal law manual not based on the Italian authors on the subject, but based on the practice and traditions existing North of the Alps. Still, it was by the works of Joost de Damhouder that this Dutch law became widely known and practiced. The present first Dutch edition on civil law is well produced, mainly printed in a small Gothic type, and very beautifully illustrated with new engraved plates, showing an allegory of Justice, and fine scenes illustrating contemporary practice, like a lawyer's office, a court-room, a prisoner breaking out of prison, a town-crier announcing a death-sentence, a scribe at work, etc. One of the engravings is monogrammed W.H. Fine copy.- (Small ticket on spine).
